1. About these terms

These Terms of Service ("Terms") apply to your use of the Elite Muscle Therapy website (elitemuscletherapy.com.au), our online booking system, our intake forms, and the services we provide. By booking an appointment, attending a session, signing up for a workshop, or otherwise interacting with EMT, you agree to these Terms.

We may update these Terms from time to time. The "Last updated" date will always reflect the most recent revision. If we make a material change we will notify existing patients by email before the change takes effect.

If you do not agree with these Terms, please do not use our services.

2. About Elite Muscle Therapy

Elite Muscle Therapy is a musculoskeletal therapy clinic operated by Yaser Moosavian. We provide remedial massage, sports and deep tissue massage, dry needling, cupping, postural assessment, exercise rehabilitation, and related musculoskeletal therapy services from our location inside Clublime Gym at 260 Keira Street, Wollongong NSW 2500.

We operate Monday to Thursday 8:00am to 4:30pm and Friday 8:00am to 12:00pm. We are closed Saturday and Sunday.

3. Bookings and appointments

Making a booking

Appointments can be booked online through our Cliniko booking system (linked from elitemuscletherapy.com.au) or by contacting us directly via email. Online bookings are confirmed by automated email once the booking is created in Cliniko.

Prepayment for new clients

First-time clients who are not claiming through a private health fund are required to prepay for their initial session at the time of booking. Prepayment is processed through Stripe via our Cliniko booking integration. Prepayment is non-refundable except as set out in our Cancellation Policy.

Returning clients

Returning clients can pay at the time of service unless otherwise arranged. Payment methods accepted include card payment (in person or online) and approved health fund claims where applicable.

Pricing

Current pricing is published on our website and is shown at the time of booking. Pricing may change from time to time. The price applicable to your appointment is the price shown at the time of booking, not the price at the time of the session.

Confirming your appointment

You will receive an appointment confirmation email after booking and an SMS or email reminder before your appointment. Please review your appointment details on confirmation and let us know promptly if anything is incorrect.

4. Cancellations and rescheduling

Our cancellation and rescheduling terms are set out in full in our Cancellation Policy. In summary:

  • Cancellations or rescheduling requests made more than 24 hours before your appointment can be made without charge.
  • Cancellations or rescheduling requests made within 24 hours of your appointment may incur a cancellation fee of up to 100% of the session cost, at our discretion.

5. Your responsibilities as a patient

To get the best outcome from your treatment and to keep yourself and our practitioner safe, you agree to:

  • Provide accurate health information. Complete the digital intake form before your first appointment and update us about any changes to your medical history, current medications, injuries, or contraindications.
  • Disclose any relevant conditions. Tell us about anything that may affect your treatment, including pregnancy, recent surgery, blood thinners, infections, allergies, or any condition that may affect your tolerance of musculoskeletal treatment.
  • Arrive on time. If you are running late, please let us know. Sessions that start late will still end at the scheduled time so that the next patient is not delayed.
  • Cancel respectfully. If you need to cancel, do so as early as possible so the slot can be offered to another patient. See our Cancellation Policy for full details.
  • Behave respectfully. Our practitioner has the right to end a session at any time if your behaviour is inappropriate, threatening, or makes the treatment unsafe.

6. Scope of our services

Elite Muscle Therapy provides musculoskeletal therapy. This is a complementary therapy that supports physical health, mobility, and recovery.

We are not. Our services do not constitute medical diagnosis, medical treatment, psychological therapy, physiotherapy regulated under AHPRA, or any service we are not qualified or registered to provide. We do not prescribe medication. We do not provide emergency medical services.

When to see a doctor. If you have new, severe, or worsening pain, neurological symptoms, signs of infection, unexplained weight loss, or any other concerning health change, please see your GP or seek appropriate medical care. Musculoskeletal therapy is not a substitute for medical assessment when one is needed.

Outcomes. We will use our skill and judgment to provide treatment that meets accepted professional standards. We cannot guarantee specific clinical outcomes. Individual response to treatment varies.

7. Health fund rebates

If you have private health insurance with extras cover that includes remedial massage or related therapies, you may be entitled to a rebate on your session cost. Health fund rebate eligibility depends on your specific policy, the level of cover, your annual limits, and whether our practitioner is recognised by your fund.

We will provide you with a receipt that you can submit to your health fund for reimbursement. If on-the-spot claiming (HICAPS or similar) is available, we will confirm this with you at the time of booking.

You are responsible for confirming with your health fund whether your treatment is covered.

8. Workshops and group sessions

From time to time we run small-group clinical workshops and group sessions on topics such as postural awareness, self-care techniques, pain management, and movement education. Workshops are run in person at our clinic location.

Expressions of interest. You can register your interest in upcoming workshops via the workshops page on our website (elitemuscletherapy.com.au/workshops). Registering interest does not commit you to attending or paying for a workshop. It simply adds your name to a list so we can contact you when sessions are confirmed.

Workshop-specific terms. Workshop costs, capacity limits, refund policies, and what is included will be published on the workshop registration page at the time bookings open. By booking and paying for a workshop you agree to those specific terms in addition to these general Terms.

Information about the workshop is educational. Workshops are educational and practical in nature. They are not a substitute for one-on-one clinical assessment or treatment. If you have acute pain or a condition that requires individual care, please book a treatment session instead.

9. Website use

You may use our website (elitemuscletherapy.com.au) for personal, non-commercial purposes related to booking and learning about our services.

You agree not to:

  • Use the website in a way that is unlawful, harmful, or that interferes with other users' use of the site.
  • Attempt to gain unauthorised access to our systems, our patient records, or any restricted area of the website.
  • Copy, reproduce, distribute, or commercially exploit the content of our website without our written permission.
  • Use automated tools, scrapers, or bots to collect information from our website.

We reserve the right to restrict access to our website or to any specific user if these terms are breached.

10. Intellectual property

All content on our website and in our communications (including text, images, logos, treatment plan templates, and educational materials) is owned by Elite Muscle Therapy or licensed to us. You may not reproduce, modify, or distribute our content without our written permission, except for personal reference related to your own treatment.

Patient information you provide to us remains yours. We hold it on your behalf and handle it in accordance with our Privacy Policy.

11. Communications

By providing your contact details to us, you consent to us using them to communicate with you about your bookings, appointments, treatment, and account.

If you have opted in to marketing communications (newsletters, special offers, workshop announcements), we will send those communications to you in accordance with our Privacy Policy and the Spam Act 2003. You can opt out at any time using the unsubscribe links provided.

12. Limitation of liability

We provide our services with care, skill, and to the standard expected of a qualified musculoskeletal therapist.

To the maximum extent permitted by Australian law, our liability to you is limited to:

  • Re-supplying the service that was deficient, or
  • Refunding the cost of the deficient session.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded by contract. If you believe you have a consumer guarantee claim, please contact us first so we can address it.

We are not liable for indirect or consequential losses, including loss of income, loss of opportunity, or distress, except where such liability cannot be excluded by law.

13. Health and safety

If at any point during a session you experience pain that is more than you expect, dizziness, nausea, or any other concerning symptom, please tell our practitioner immediately. We will stop the treatment and take appropriate action.

After a session, mild soreness or tiredness is normal. If you experience anything unexpected (significant pain, bruising, or any other concern), please contact us as soon as possible.

14. Privacy

Your personal and health information is handled in accordance with our Privacy Policy. The Privacy Policy explains what we collect, why, who we share it with, how we protect it, and your rights to access and correct it.

15. Children and young people

We provide services to patients under 18 with the consent of a parent or guardian. A parent or guardian must complete the intake form, sign the consent, and (for patients under 16) accompany the young person to their appointment.

16. Resolving disputes

If you have a concern about your treatment, our services, or these Terms, please contact us first at [email protected]. We will respond promptly and try to resolve the issue directly.

If a complaint involves your privacy or how we handled your information, see the Complaints section of our Privacy Policy for the steps to follow, including how to contact the Office of the Australian Information Commissioner.

If a complaint relates to our professional conduct, you may contact our registered association (details available on request).

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or from our services will be resolved in the courts of New South Wales.

We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Material changes will be notified to existing patients by email before the change takes effect. The current version of these Terms will always be available at elitemuscletherapy.com.au/terms-of-service.
